Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BirthdayGlow AI (“the App”), operated by RadSta Solutions (“we”, “us”, or “our”).

By downloading, accessing, purchasing through, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old or meet the higher minimum age required in your country. If you are not legally able to enter into a binding agreement, you may use the App only with permission from a parent or legal guardian.

To make a purchase, you must be legally authorized to use the selected Google Play account and payment method.

2. Description of the service

BirthdayGlow AI allows users to upload or take a photograph and generate an AI-created portrait using selected styles, wishes, and other generation options.

AI-generated results may be inaccurate or unexpected, differ from the original person, contain visual imperfections, fail to follow every instruction, and vary between attempts. We do not guarantee an exact likeness, specific artistic result, generation time, or uninterrupted availability.

3. User photographs and instructions

You retain any rights you have in photographs and instructions submitted through the App.

You grant us and our service providers a limited, non-exclusive permission to process submitted content only as necessary to generate and deliver the requested portrait, detect unsafe content, prevent fraud and abuse, diagnose failures, and comply with law.

You confirm that:

• You own the submitted photograph or have permission to use it.
• You have obtained any required consent from people shown in it.
• You have lawful parental or guardian authority when uploading a photograph of a child.
• Your content does not violate privacy, copyright, publicity, or other third-party rights.
• Your use of the resulting portrait will comply with applicable law.

4. Prohibited use

You may not use the App to:

• Upload photographs without the required rights or permission.
• Generate illegal, abusive, hateful, threatening, or exploitative content.
• Generate sexual or exploitative content involving minors.
• Harass, threaten, defame, or impersonate another person.
• Mislead others about the authenticity of AI-generated content.
• Create false identity documents, official records, or evidence.
• Commit fraud or facilitate unlawful activity.
• Violate intellectual property, privacy, publicity, or other rights.
• Bypass quotas, purchases, rate limits, or security measures.
• Reverse engineer, attack, automate, overload, disrupt, or interfere with the App.
• Use bots, scripts, emulators, or other methods to obtain unauthorized free generations or credits.

We may refuse generation requests or restrict access when reasonably necessary for safety, legal compliance, fraud prevention, or service protection.

5. Free portrait allowance

The App currently provides three free portrait generations per device.

The free allowance has no cash value, cannot be sold or transferred, and may not be restored after reinstalling the App, clearing App data, resetting the device, or changing devices. It may be restricted where abuse or attempts to bypass limits are detected.

6. Portrait credit packs

The App offers consumable, one-time portrait credit packs:

• Birthday — 5 portrait credits
• Family — 15 portrait credits
• Celebration — 35 portrait credits

Portrait packs are one-time purchases. They are not subscriptions and do not renew automatically. Multiple packs may be purchased, and unused credits accumulate locally on the device.

The applicable price and currency are displayed by Google Play before purchase. Prices may vary by country, currency, taxes, exchange rates, and Google Play pricing rules.

7. Local storage of portrait credits

Google Play’s purchase restoration function may not restore consumable products or the locally recorded unused balance. You should consider this limitation before purchasing a pack.

If you lose recently purchased credits, contact radstasolutions@gmail.com and include your Google Play order information. We may review the transaction and attempt to assist, but restoration is not guaranteed where the purchase or remaining balance cannot be verified.

Nothing in this section limits mandatory consumer rights available under applicable law.

8. Credit reservation and failed generations

One portrait credit is normally reserved when generation begins. If generation fails before a portrait is delivered because of a recognized network, server, processing, or rate-limit error, the reserved credit should be returned automatically.

A credit is considered used after the App successfully receives the generated portrait. Deleting a successfully generated portrait does not return the credit.

9. Purchases and payment processing

Payments are processed through Google Play and are subject to Google Play’s terms, payment policies, your Google account and payment method terms, and applicable consumer law. RevenueCat may be used to retrieve products and verify purchase status.

We do not directly receive or store your complete payment card or bank account details. You are responsible for protecting your Google Play account and preventing unauthorized purchases.

10. Refunds

Refund requests should normally be submitted through Google Play. Eligibility is determined under Google Play policies, the circumstances of the purchase, and applicable consumer law.

Nothing in these Terms excludes mandatory refund, cancellation, warranty, or consumer rights. If a purchase is refunded, reversed, cancelled, or charged back, we may remove or invalidate credits associated with it.

11. AI-generated content

Generated portraits are provided for creative and entertainment purposes. They should not be treated as identity documents, official evidence, professional advice, guaranteed accurate representations of a person, or proof that an event occurred.

You are responsible for reviewing generated content before saving, publishing, printing, or sharing it. You must not present it in a way intended to deceive, defraud, impersonate, or harm another person.

12. Use of generated portraits

To the extent permitted by law and third-party rights, you may use generated portraits for personal, non-commercial purposes, including saving, personal printing, private sharing, and posting on personal social media accounts.

We do not guarantee that output is unique, eligible for copyright protection, free from every possible third-party claim, or suitable for commercial use. Commercial use requires our prior written permission unless applicable law or separate written terms provide otherwise.

13. Intellectual property

The App, including its software, interface, designs, branding, text, icons, and original materials, is owned by or licensed to RadSta Solutions. These Terms do not transfer ownership of the App or its underlying technology to you.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or commercially exploit the App except where such restriction is prohibited by law.

14. Local portrait history and data loss

Generated portraits and related information may be stored locally. You are responsible for saving or backing up portraits you wish to keep.

We do not guarantee permanent storage or recovery of generated portraits, uploaded photographs, birthday calendar entries, settings, credit balances, or other local data.

15. Service availability and limits

We may apply reasonable request limits, safety filters, rate limits, or temporary restrictions to protect the service, prevent abuse, maintain capacity, enforce usage rules, and comply with provider requirements.

The service may be unavailable because of maintenance, network failures, external provider failures, technical errors, capacity limits, safety systems, or events outside our reasonable control. We do not guarantee continuous or error-free operation.

16. Changes to the service

We may modify, add, replace, suspend, or discontinue features and may change external providers where reasonably necessary. Where reasonably possible, material changes will be communicated through the App or updated terms.

17. Privacy

Our processing of personal information is described in the BirthdayGlow AI Privacy Policy.

By using portrait generation, you acknowledge that your photograph and instructions must be transmitted to external providers to generate the requested portrait.

18. Disclaimer

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available.” We do not guarantee continuous operation, a specific generation time, exact resemblance, a particular artistic outcome, permanent availability of local content or credits, or suitability for every purpose.

This section does not exclude warranties or protections that cannot legally be excluded under consumer law.

19. Limitation of liability

To the maximum extent permitted by law, RadSta Solutions will not be liable for indirect, incidental, special, or consequential losses resulting from use or inability to use the App, loss of local credits or data, device failure, unauthorized use of photographs, reliance on AI output, service unavailability, or actions of external providers.

Where liability cannot be completely excluded, our total liability relating to a paid portrait pack will not exceed the amount paid for the purchase giving rise to the claim, except where applicable law requires otherwise. Nothing excludes liability that cannot legally be limited.

20. Suspension and termination

We may suspend or terminate access where a user seriously or repeatedly violates these Terms, uses the App illegally, bypasses payments or restrictions, submits prohibited content, threatens service security, or uses fraudulent or refunded purchases.

You may stop using the App at any time by uninstalling it. Uninstalling may permanently remove locally stored portraits and credits.

21. Changes to these Terms

We may update these Terms to reflect changes to the App, purchases, providers, security requirements, or law. The latest version will be published on this page with a revised “Last updated” date. Where required, we will provide additional notice of material changes.

22. Applicable law and consumer rights

These Terms are governed by applicable law. Nothing limits mandatory consumer rights available in your country of residence.

If a dispute cannot be resolved by contacting us, you may use courts, consumer authorities, or dispute-resolution procedures available under applicable law.

23. Severability

If any part of these Terms is found invalid or unenforceable, the remaining sections will remain effective to the extent permitted by law.

24. Entire agreement

These Terms and the Privacy Policy constitute the agreement governing your use of BirthdayGlow AI, except where additional mandatory terms are imposed by Google Play or applicable law.
